1. Agreement to Terms

By booking a tour or using the Island Mystiq Tours website, you agree to these Terms of Service. These terms govern all bookings, purchases, and interactions with Island Mystiq Tours, operated by Hugh Chambers in Jamaica. If you do not agree, please do not use our services.

2. Booking & Payment

• All tours must be paid in full at the time of booking to secure your spot.
• Prices are quoted in USD. Jamaican dollar (JMD) amounts shown are for reference only and may fluctuate with the exchange rate.
• Payments are processed securely via Stripe (credit/debit card). Your card details are never stored on our servers.
• You will receive a booking confirmation by email within a few minutes of completing payment.
• Group sizes are limited by vehicle capacity (maximum 7 guests). For larger groups, contact us to arrange additional vehicles.

3. Cancellation & Refunds

• 48+ hours before tour: Full refund to original payment method within 5-10 business days.
• Within 48 hours: Non-refundable. You may reschedule (subject to availability) if you contact us at least 24 hours before the tour.
• Cancellation by us: If we cancel a tour for any reason (including severe weather), you will receive a full refund or a complimentary reschedule — your choice.
• No-shows: Non-refundable.

4. Guest Responsibilities

• Guests must arrive at the pickup location or meeting point at the scheduled time. We will wait a maximum of 15 minutes before departing.
• Guests must inform us of any medical conditions, mobility limitations, or dietary requirements that may affect their participation in a tour.
• Guests are responsible for their personal belongings at all times.
• Guests must behave respectfully toward our guide, other guests, and local communities and businesses visited during the tour.
• Island Mystiq Tours reserves the right to remove any guest from a tour without refund for disruptive, dangerous, or disrespectful behaviour.

5. Health & Safety

• Some tours involve physical activity (hiking, swimming, climbing). You are responsible for assessing whether a tour is appropriate for your fitness level.
• Children under 18 must be accompanied by a parent or guardian at all times.
• Island Mystiq Tours operates in accordance with Jamaican tourism regulations and maintains appropriate vehicle insurance.
• We are not liable for injuries arising from guests failing to follow safety instructions provided by the guide.

6. Limitation of Liability

Island Mystiq Tours is not liable for any loss, injury, or damage to persons or property arising from circumstances beyond our reasonable control, including weather events, road conditions, acts of third parties, or force majeure events. Our total liability shall not exceed the amount paid for the affected tour booking.

7. Photography & Media

By participating in a tour, you grant Island Mystiq Tours permission to use photographs or videos taken during the tour for marketing purposes. If you prefer not to be photographed, please inform your guide at the start of the tour.

8. Changes to These Terms

We may update these Terms of Service from time to time. Changes will be posted on this page with an updated date. Continued use of our services after changes constitutes acceptance of the new terms.

9. Governing Law

These terms are governed by the laws of Jamaica. Any disputes shall be subject to the exclusive jurisdiction of the courts of Jamaica.
